Buyer - Terms & Conditions (T&Cs)

These Terms apply to all Buyers, including individual consumers, informal groups, community organisations, and businesses (collectively, “you”, “Buyer”) purchasing products through The Fair Grocer marketplace, operated by Fairbite Ltd, registered company 14371363 in England & Wales.

By placing an order on The Fair Grocer website or via any associated ordering channel, you agree to these Terms.

1. Role of The Fair Grocer

The Fair Grocer operates as an online marketplace, facilitating transactions between independent sellers (“Vendors”) and Buyers.

  • We are not the producer, owner, or seller of the products unless explicitly stated.
  • Each product is sold directly by the Vendor listed on the product page.
  • The contract for sale is between you and the Vendor, not with The Fair Grocer.

This structure is consistent with established multi-vendor marketplaces that include food and perishable goods.

2. Buyer Eligibility

To purchase via The Fair Grocer, you confirm that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into a binding contract.
  • If purchasing on behalf of a business, group, or organisation, you are authorised to do so.

3. Product Information & Availability

  • Product descriptions, prices, origin, ingredients, allergens, and availability are provided by Vendors.
  • While we encourage accuracy and transparency, The Fair Grocer does not guarantee that descriptions are error-free.
  • Images are illustrative unless otherwise stated.

Seasonal, fresh, or handmade products may vary naturally in size, colour, or appearance.

4. Orders & Acceptance

  • An order is considered placed once payment is successfully completed.
  • An order is considered accepted once the Vendor confirms availability and fulfilment.
  • Vendors reserve the right to decline or cancel orders due to stock issues, pricing errors, or logistical constraints.

If an order cannot be fulfilled, you will be notified promptly and refunded in accordance with Section 7.

5. Pricing, Fees & Fair Pricing Model

  • Prices are set by Vendors in agreement with The Fair Grocer.
  • Prices shown include any applicable marketplace service fee.
  • In line with The Fair Grocer’s mission, a portion of the service fee may be shared between Buyer and Vendor to support fair access, ethical trade, and community sustainability.

Delivery fees, if applicable, are clearly shown at checkout.

6. Delivery & Collection

Delivery or collection terms depend on the Vendor and will be clearly stated on the product or order page.

Delivery models may include:

  • Courier delivery organised by the Vendor
  • Local delivery
  • Click & collect
  • Group or community drop-offs

The Fair Grocer is not responsible for delays caused by couriers, weather, or circumstances beyond reasonable control.

7. Cancellations, Refunds & Perishable Goods

Non-perishable goods

You may have statutory cancellation rights under UK consumer law. Where applicable, refunds are handled by the Vendor via The Fair Grocer.

Perishable goods (including fresh food)

  • Orders for perishable goods are generally non-cancellable once confirmed.
  • Refunds or replacements may be issued if products arrive:
    • Damaged
    • Unsafe
    • Incorrect

You must notify us within 24 hours of receipt, providing clear photos and a description of the issue.

8. Food Safety & Allergens

  • Vendors are responsible for compliance with UK food safety and allergen regulations (including Natasha’s Law).
  • You are responsible for reviewing ingredient and allergen information before purchasing.

The Fair Grocer cannot accept liability for allergic reactions or dietary issues arising from incomplete or misunderstood information.

9. Use of the Platform

You agree to:

  • Use the platform lawfully and in good faith.
  • Not abuse refund systems, Vendors, or staff.
  • Communicate respectfully with Vendors and The Fair Grocer team.

We reserve the right to suspend or restrict accounts for misuse or abuse.

10. Limitation of Liability

To the maximum extent permitted by law:

  • The Fair Grocer is not liable for losses arising from Vendor actions, product quality, or delivery failures.
  • Our total liability, where applicable, is limited to the value of the order placed.

Nothing in these Terms limits your statutory consumer rights.

11. Data Protection & Marketing

We process personal data in accordance with UK GDPR and our Privacy Policy.

  • Buyer data is shared with Vendors for order fulfilment and customer service purposes.
  • We may use your contact information to send promotional materials, priority access to new offers, newsletters, and other marketing communications from The Fair Grocer and its partners.
  • You may manage your preferences or withdraw consent at any time by contacting hello@thefairgrocer.co.uk.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website.

Continued use of the platform constitutes acceptance of updated Terms.

 

13. Governing Law

These Terms are governed by the laws of England and Wales.
